We are thinking of developing a central hotel room reservation software (for hotels for booking rooms) and selling it as a technology service to hotels. While the major business activity of the software is to sell hotel rooms which is Halal, some hotels might use the same platform to sell packages like bottle of wine on arrival, etc. This may not be in our control though we will be hosting the software. We will also not be making any money from sale of alcohol. Is it haram to sell the platform?
Answer:
If all the hotels that have entered an instance of your program sell alcohol or give alcohol, then I do not advice entering into that program as Allāh (سبحانه وتعالى) said:
(وَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَىٰ ۖ وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ وَالْعُدْوَانِ)
“Help you one another in Al-Birr and At-Taqwa (virtue, righteousness and piety); but do not help one another in sin and transgression.”
[Surah al-Ma’idah 5:2]
But if the liquor is sold by some hotels and not all, then there is no issue because your agreements are for reservation of the hotel rooms, not the additional fringe affairs. For the ruling is applicable upon the origin (of the affair) which is predominant, and not upon the subsidiary branch, the finer details of which is not under your control.

س: نحن نفكر أن نصنع برنامج لحجز غرف الفنادق ويبيع هذا خدمة الى فنادق. استعمال الرئيسي للبرنامج بيع غرف الفنادق،لكن بعض الفنادق قد يستعمل ذلك ليعطى عروض مع بيع الغرف مثل زجاجة خمرة عند الوصول إلى الفندق، الخ. هذا لن يكون في سيطرتنا على رغم أن استضافة البرنامج سيكون عندنا. وايضا نحن لا ننتفع من بيع خمرة. فهل يجوز بيع هذا البرنامج/الخدمة؟
ج: إذا كان جميع الفنادق التي دخلت في أسلاك برنامجكم كلها تبيع الخمور أو تعطي خمورا فلا أنصح الدخول في ذلك البرنامج لأن الله قال: (وتعاونوا على البر والتقوى ولا تعاونوا على الإثم والعدوان).
ولكن إذا كان الذي يبيع الخمور بعض الفنادق وليس الكل، فلا بأس ذلك لأن عقودكم هي في حجز غرف الفنادق لا أمور جانبية إضافية، فالحكم ينطبق على الأصل الغالب، لا على الفرع الإضافي الذي ليس تحت قدرتكم ضبط تفاصيلها.
