▪️Fighting the ruler in defence of one’s property▪️
Our Shaykh, Muhammad ibn Hizaam -may Allaah preserve him- was asked the following question:
The questioner says: How do we reconcile between the saying of the prophet ﷺ: ‘Listen to the ruler obey him even if he strikes your back and takes your money’, and the hadeeth: ‘Whoever is killed defending his property, dies a martyr’?
The hadeeth: ‘Whoever is killed defending his property, dies a martyr’ is a general statement which does not include the rulers; i.e. you are not allowed to fight against the ruler.
The prophet ﷺ said ‘fulfill the right which is upon you and ask Allah for the right which is yours, for verily Allah will ask them about those that Allah has put under their gaurdianship’.
So it’s impermissible to fight against the ruler. If he takes your property unjustly, he has oppressed you, so what’s upon you is to make Du’aa, because there’s no barrier between the Du’aa of the oppressed and Allah, (i.e. it will surely be answered).
As for fighting against the rulers, then this is not permissible. If there is a person / body that can reprimand him for this, he can raise his case with them in order for them to intercede for him. However, complaining to Allah is sufficient; since this may land him in further trouble.
